TERMS OF SERVICE

1. DEFINITIONS
1.1 “Arkive” means Arkive B.V. and its software platform available via arkivedpp.eu.
1.2 “Platform” means the Arkive digital infrastructure used to create, manage and publish Digital Product Passports (DPPs), CO₂ insights, Life Cycle Assessment calculations, compliance status indicators, QR codes and related data services.
1.3 “Customer” means any company, organization or individual creating an account or using the Platform.
1.4 “DPP” means a Digital Product Passport generated through the Platform.
1.5 “Data” means all product, supply chain, material, lifecycle, environmental, certification and documentation information uploaded, integrated or entered by the Customer or its partners.
2. NATURE OF THE SERVICE
2.1 Arkive provides a software-as-a-service platform that enables Customers to structure product data and generate Digital Product Passports.
2.2 The Platform may include features such as automated Life Cycle Assessment calculations, compliance status indicators, CO₂ dashboards, QR identifiers, API integrations and document storage.
2.3 Arkive provides technical infrastructure only. Arkive does not act as a regulatory authority, certification body, auditor, consultant, inspector or legal advisor.
2.4 Use of the Platform does not constitute regulatory certification, legal advice or guaranteed compliance with any law, standard or regulatory framework.
3. CUSTOMER DATA RESPONSIBILITY
3.1 The Customer is solely responsible for the accuracy, completeness and legality of all Data provided to the Platform.
3.2 Arkive does not verify the accuracy of Data uploaded by the Customer, its suppliers or third parties.
3.3 All regulatory obligations relating to Digital Product Passports, sustainability disclosures, material declarations or environmental reporting remain the responsibility of the Customer.
3.4 The Customer acknowledges that Digital Product Passport regulations place legal responsibility on the economic operator placing the product on the market.
3.5 Arkive shall not be liable for incorrect, incomplete, misleading or outdated Data provided by the Customer or any supply chain partner.
4. DATA COLLECTION AND SUPPLY CHAIN DATA
4.1 Digital Product Passport compliance requires extensive supply chain and product data that may originate from suppliers, manufacturers, laboratories or third-party systems.
4.2 Arkive provides tools to structure, integrate and manage this data but does not guarantee that all required data is available or complete.
4.3 The Customer remains responsible for obtaining all required data from suppliers, partners or internal systems.
4.4 Arkive may provide integrations, APIs or partner connections to facilitate data collection, but Arkive is not responsible for the availability or quality of third-party data.
5. LCA CALCULATIONS AND AUTOMATED MODELS
5.1 The Platform may provide automated Life Cycle Assessment calculations and environmental impact modeling based on available product data.
5.2 These calculations rely on datasets, assumptions, emission factors and available Data inputs.
5.3 Results generated by the Platform are computational outputs and may contain estimates where primary data is not available.
5.4 Arkive does not guarantee the accuracy, completeness or regulatory acceptance of any LCA calculation or environmental metric.
5.5 The Customer remains fully responsible for validating any environmental claims or regulatory submissions derived from the Platform.
6. COMPLIANCE STATUS INDICATORS
6.1 The Platform may display indicators such as verified, unverified or attention required.
6.2 These indicators are system signals based on available Data and rule sets.
6.3 Such indicators do not constitute legal compliance confirmation, certification or regulatory approval.
6.4 The Customer remains solely responsible for determining whether its products comply with applicable regulations.
7. INTEGRATION AND IMPLEMENTATION
7.1 The Platform provides APIs and data specifications to enable integration with ERP, PIM, PLM or other enterprise systems.
7.2 Integration timelines depend on the Customer’s internal systems and the availability of required product data.
7.3 Arkive is not responsible for delays caused by missing product data, incomplete supply chain information or internal system limitations of the Customer.
8. THIRD-PARTY PARTICIPATION
8.1 The Platform may allow Customers to grant access to suppliers, inspectors, laboratories or other third parties.
8.2 Arkive does not control, verify or assume responsibility for any Data submitted by third parties.
8.3 The Customer remains responsible for managing third-party access and validating any data they submit.
9. DOCUMENTS AND COMPLIANCE MATERIAL
9.1 The Platform may allow Customers to upload, store or purchase supporting compliance documents such as certificates, declarations or lifecycle reports.
9.2 Arkive does not guarantee the regulatory validity, acceptance or sufficiency of any document stored or generated through the Platform.
9.3 Responsibility for regulatory documentation remains with the Customer.
10. SUBSCRIPTIONS AND PRICING
10.1 Arkive offers subscription plans including Free, Starter, Growth and Enterprise plans.
10.2 Each plan provides a defined number of Digital Product Passports or platform features as described on the Arkive pricing page.
10.3 Subscriptions renew automatically unless cancelled in accordance with the applicable billing terms.
10.4 Enterprise agreements may include custom pricing and contractual terms.
10.5 Arkive reserves the right to modify pricing, features or usage limits for future subscription periods.
11. PLATFORM AVAILABILITY
11.1 Arkive will make reasonable efforts to maintain availability of the Platform.
11.2 The Platform may be unavailable due to maintenance, updates or technical issues.
11.3 Arkive does not guarantee uninterrupted or error-free operation.
12. LIMITATION OF LIABILITY
12.1 Arkive shall not be liable for regulatory fines, compliance failures, incorrect sustainability disclosures or legal consequences resulting from Customer Data or product information.
12.2 Arkive shall not be liable for decisions made by Customers based on Platform outputs.
12.3 To the maximum extent permitted by law, Arkive’s total liability shall not exceed the amount paid by the Customer for the Platform in the preceding twelve months.
13. CUSTOMER OBLIGATIONS
13.1 The Customer shall ensure that all Data uploaded to the Platform is lawful, accurate and authorized for use.
13.2 The Customer shall not use the Platform for unlawful, fraudulent or misleading sustainability claims.
13.3 The Customer is responsible for maintaining internal processes required to comply with applicable product regulations.
14. MODIFICATIONS
14.1 Arkive may modify the Platform, its features or these Terms of Service.
14.2 Continued use of the Platform constitutes acceptance of the updated Terms.
15. GOVERNING LAW
15.1 These Terms shall be governed by the laws of the Netherlands.
15.2 Any disputes shall be submitted to the competent courts in the Netherlands.
